1. Introduction

This Privacy Policy explains how Nimblebot, LLC ("HYPE" "HYPE Social" "HYPE App," "we," "our," "us") collects, uses, discloses, and protects personal information in connection with our mobile applications, websites, and related services (the "Services").

This Policy does not cover information that does not identify you or the practices of other HYPE users. Other users may view your public profile inside the Services.

2. Information We Collect

2.1 Information You Provide

  • Account data: name, phone number, email.
  • Profile data: photo, bio, other info you choose to display. We retain prior profile photos for trust and safety.
  • Interests: topics you select for personalization; you can show or hide them.

2.2 Information Collected Automatically

  • Usage data: streams created/joined, speaking activity, initiatives/campaigns joined, clips, replays, follows, links shared, searches, profile updates.
  • Messages: stored to deliver the service and enforce our policies; reviewed if flagged or required by law.
  • Device and technical data: hardware model, OS version, device memory, installed apps, unique identifiers, browser type, IP address, wireless/mobile network details (including phone number and provider).
  • Cookies and similar technologies: for functionality, analytics, and measurement. See our Cookie Policy.
  • Media shared in messages: including photos, videos, and audio, is stored securely on our servers to deliver the Service, enable replays, and enforce our policies. Such media is retained in accordance with our retention policy in Section 8.

3. How We Use Information

3.1 Purposes

  • Register and manage accounts; verify identity.
  • Provide, operate, maintain, and improve the Services.
  • Personalize content, connections, and recommendations.
  • Communicate about account activity, features, updates, and policy changes (email, SMS, in-app).
  • Monitor safety and security; prevent fraud, abuse, and violations.
  • Analyze engagement, performance, and product metrics.
  • Comply with law and enforce our terms.
  • Handle user rights requests and consent preferences.

3.2 Legal Bases (where applicable)

  • Performance of a contract.
  • Legitimate interests (product security, personalization, analytics).
  • Consent (marketing, certain cookies, processing of sensitive data).
  • Legal obligations.

4. Sensitive Data

Users may choose to share information that could reveal political opinions, activism, or other special category data. We process such data only with explicit consent or as allowed by law. You can withdraw consent in settings.

5. Children's Privacy

The Services are not directed to individuals under 13 years of age (or the minimum age of digital consent in your jurisdiction). We do not knowingly collect data from such individuals. If we learn we have, we will delete it.

6. How We Share Information

We do not sell or "share" personal information for cross-context behavioral advertising.

We may disclose personal information:

  • At your direction (e.g., to linked social platforms).
  • To service providers acting on our instructions for hosting, analytics, security, moderation, customer support, and communications.
  • For legal compliance and safety (see Section 11).
  • In a corporate transaction (merger, acquisition, reorganization, or sale of assets).
  • To protect rights, property, or safety of users, the public, or HYPE App.
  • We may include third-party SDKs in our Services for purposes such as crash reporting, analytics, and customer support. These SDKs process only the data necessary for their function and are not permitted to use it for targeted advertising.

7. Security

We use reasonable administrative, technical, and physical measures (encryption, access controls, monitoring) to protect personal information. No method is fully secure. We cannot guarantee absolute security.

You are responsible for protecting your credentials, securing your devices, and reviewing account activity. Contact us if you suspect unauthorized access.

8. Data Retention

We keep personal information only as long as needed for the purposes in this Policy or as required by law.

  • Account data: retained while your account is active. Upon deletion, we remove or de-identify data unless retention is required for security, fraud prevention, legal obligations, or disputes.
  • Stream recordings: if flagged for potential violations, retained until the investigation is complete; otherwise deleted within 10 minutes after a room ends.
  • Contacts: deleted if you disable syncing or request deletion.

We apply documented criteria to set retention periods, including legal requirements, operational needs, and user choices.

9. International Transfers

We are based in the United States and may process data in the U.S. and other countries where our providers operate. These locations may have different data protection laws. Where required, we use appropriate safeguards for transfers.

10. Your Privacy Choices and Rights

Depending on your location, you may have the right to:

  • Access and obtain a copy of your data.
  • Request correction or deletion.
  • Object to or restrict processing.
  • Request data portability.
  • Withdraw consent, where processing is based on consent.

How to exercise rights:

We will verify your request and respond within required timeframes.

Notification controls:

  • Manage push notifications in device or in-app settings.
  • Pause or reduce notifications in account settings.
  • Disconnect linked social accounts at any time.

11. Law Enforcement and Legal Requests

We review all requests for legal sufficiency. We disclose only the information required and, where legally permitted and feasible, we notify affected users. We may preserve information to comply with valid legal process.

12. Changes to This Policy

We may update this Policy. We will post updates with a new "Last Updated" date and will obtain consent where required by law.
